1. Acceptance of Terms

By accessing or using 8-Bit Cupid ("the Service"), operated at 8bitcupid.com by Opinionated Panda Private Limited ("the Company"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and Opinionated Panda Private Limited.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.

3. Description of Service

8-Bit Cupid is a web application that allows users to create personalized retro pixel-art games with custom messages as gifts. Users select a game template, write personal messages, preview the game, pay a one-time fee, and receive a shareable link. Recipients can play the game without creating an account.

4. Accounts

To create games, you must register for an account. You are responsible for maintaining the security of your account and all activity that occurs under it. You agree to provide accurate and complete information during registration.

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent or abusive purposes.

5. User Content

You are solely responsible for all content you create through the Service, including recipient names, messages, and final messages ("User Content"). You retain ownership of your User Content.

By creating and publishing a game, you grant Opinionated Panda Private Limited a limited, non-exclusive license to store, display, and deliver your User Content as necessary to operate the Service (i.e., to make the game playable via the shareable link).

You agree not to create User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Infringes on any intellectual property or other proprietary rights of any party
  • Contains personally identifiable information of others without their consent
  • Is intended to harass, bully, intimidate, or threaten any individual
  • Promotes illegal activities or violence
  • Contains malware, spam, or any form of malicious content

We reserve the right to remove any User Content that violates these terms and to terminate the accounts of repeat offenders.

6. Payments, Refunds & Cancellations

6.1 Pricing

Publishing a game costs ₹199 (INR) per game as a one-time payment. Creating drafts, previewing games (with watermark), browsing templates, and playing demos are free. You may create unlimited games; each game requires a separate payment to publish.

6.2 Payment Processing

Payments are processed through Cashfree. By making a payment, you agree to Cashfree's terms of service and payment policies. All prices are listed in Indian Rupees (INR).

6.3 Refunds & Cancellations

All payments are final and non-refundable. Since the service delivers a digital product (a published game with a shareable link) that is immediately accessible upon payment, refunds are generally not available.

You may delete a published game at any time, but this does not entitle you to a refund.

In exceptional circumstances (e.g., technical issues preventing game delivery), refund requests may be reviewed on a case-by-case basis. To request a review, email support@8bitcupid.com with your transaction details.

7. Free Features

You may browse game templates, play demos, create draft games, and preview games (with watermark) at no cost. These features are provided as-is and may be modified or discontinued at any time.

8. Intellectual Property

The Service, including its game templates, code, graphics, audio, animations, user interface, and design, is owned by Opinionated Panda Private Limited and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

You retain ownership of the messages and text content you write. However, the game templates, sprites, audio, and all other creative assets used in your games remain the property of Opinionated Panda Private Limited.

9. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to circumvent the payment or watermark system
  • Access or tamper with other users' accounts or data
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Resell, redistribute, or commercially exploit the Service without authorization
  • Impersonate any person or entity

10. Game Availability

Published games are hosted on our platform and accessible via shareable links. We aim to keep published games available indefinitely but do not guarantee perpetual availability. We reserve the right to remove games that violate our terms. We will make reasonable efforts to notify you before removing a published game, except in cases of clear policy violations.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Opinionated Panda Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
